Terms of Use

These terms are between you and Prometheus Labs of Kitchener, Ontario ("we", "us"). By using this website you accept these terms. If you do not agree, please do not use the site.

Our products

Each paid product is licensed for your own use. What is included and the terms of the licence are shown on the product's own website, and the product's own terms, published there, also apply to it. Where a product's own terms differ from these, the product's terms govern that product, except that the "Your consumer rights" section and the consumer paragraph under "Warranties and liability" below always apply. Refund terms are in each product's own terms.

Your consumer rights

In these terms, a "consumer" is an individual buying for personal, family or household use rather than for a business. If you are a consumer, nothing in these terms limits the rights you have under Ontario's Consumer Protection Act, 2002 (or any law that replaces it) or any other consumer protection law that applies to you. Where these terms and that law differ, the law applies.

Warranties and liability

We work hard to keep our tools reliable, but beyond what these terms promise (and beyond rights that the law does not allow us to limit), tools are provided as they are.

If you are a consumer, the warranties and conditions that consumer protection law gives you (for example, that services will be of reasonably acceptable quality) always apply, and the limit on our liability below does not apply to claims under them.

If you are buying for a business, then to the extent the law allows, we give no warranties or conditions beyond those in these terms, including implied ones about quality or fitness for a particular purpose.

To the extent the law allows, our total liability for any claim is limited to the amount you paid us for the tool involved.

How we handle personal information is described in our privacy policy.

Changes

We may update these terms from time to time. The "last updated" date above shows when they last changed.

Governing law

These terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.
