Ready-made products
Each paid product is licensed for your own use. The price, what is included, and the terms of the licence are shown on the product page and on your receipt. Photo Admin is a one-time purchase, not a subscription. Refund terms are stated on each product page; for Photo Admin, reply to your receipt email within 30 days if it did not do what you needed.
Custom software: how engagements work
Custom work always starts with a written quote that states what the tool will do, the price (one-time, monthly, or both), and a delivery estimate. Nothing is built and nothing is owed until you accept the quote, and the price does not change after acceptance unless we agree in writing to change the scope.
When the build is finished, we show you the tool working. Payment is due when the tool does what the quote promised; the software (or your access to it) is handed over on payment. For 30 days after delivery of a purchased build, we fix any defect (behaviour that contradicts the quote) free of charge. Ongoing updates beyond that window are available under an optional support plan where the quote offers one.
Ownership
When you buy a build outright, the tool is yours: you receive the software and a perpetual right to use it for your own purposes. We retain the right to reuse generic building blocks (code and design that are not specific to you or your data) in other work. Your data is yours in every case.
Leased tools
A leased tool is owned, hosted, and maintained by us; you subscribe to it. Updates and support are included. You can cancel at any time and your access ends at the end of the paid period. Three standing commitments apply to every lease: we export your data to you on request within 14 days of cancellation; the price does not change without 30 days' written notice; and if we ever discontinue the tool, you get at least 60 days' notice plus your data, and where practical a one-time buyout option.
Your consumer rights
Nothing in these terms limits any rights you have under the Ontario Consumer Protection Act, 2002 or any other consumer protection law that applies to you.
Warranties and liability
We work hard to keep our tools reliable, but beyond what these terms and your quote promise (and beyond rights that the law does not allow us to limit), tools are provided as they are, and our total liability for any claim is limited to the amount you paid us for the tool involved.
Changes
We may update these terms from time to time. The "last updated" date above shows when they last changed. Changes do not apply retroactively to a quote you have already accepted.
Governing law
These terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.
